Terms of Use

Terms of Use

1. Introduction

These Terms of Use (“Terms”) govern your access to and use of Dooneyd’s official website (the “Website”), including all content, features, and services offered on the Website—such as browsing product listings (handbags, wallets, business cases, travel accessories, apparel, shoes, watches), creating a user account, placing orders, and interacting with customer support. By accessing or using the Website, you (“User”) acknowledge that you have read, understood, and agree to be bound by these Terms, as well as Dooneyd’s Privacy Policy, Terms of Purchase, and other applicable policies posted on the Website.
If you do not agree to these Terms, you must not access or use the Website.

2. Eligibility

To use the Website (including creating an account and placing orders), you must meet the following requirements:
  • Be at least 18 years of age; if you are under 18, you may use the Website only with the supervision and written consent of a parent or legal guardian, who will be held responsible for your compliance with these Terms.
  • Have the legal capacity to enter into a binding contract (e.g., not under a legal disability that prevents you from forming contracts).
  • Provide accurate, complete, and current information when required (e.g., during account registration or order placement).
  • Comply with all applicable laws, regulations, and these Terms.
Dooneyd reserves the right to verify your eligibility and restrict or terminate your access to the Website if you fail to meet these requirements.

3. User Account Creation & Management

3.1 Account Registration

You may create a User Account to access additional Website features, such as saving shipping addresses, tracking order history, and managing preferences. When registering, you must provide a valid email address and create a secure password. You warrant that all information provided during registration is true, accurate, and complete.

3.2 Account Responsibility

You are solely responsible for:
  • Maintaining the confidentiality of your account credentials (email address and password). Dooneyd will not be liable for any unauthorized access to or use of your account resulting from your failure to protect these details.
  • All activities conducted under your account, including orders placed, changes to account information, and communications with customer support.
  • Notifying Dooneyd immediately via email ([email protected]) if you suspect unauthorized access to your account, or if your password is lost, stolen, or compromised.

3.3 Account Suspension & Termination

Dooneyd may suspend or terminate your account at any time, with or without prior notice, if:
  • You violate these Terms or any other Dooneyd policy (e.g., providing false information, fraudulent ordering).
  • Your account is inactive for a continuous period of 24 months (we will send a notification to your registered email address 30 days before termination to allow reactivation).
  • We determine that your account use poses a risk to the Website, other Users, or Dooneyd’s business.
Upon account termination, you will lose access to account-specific features (e.g., order history, saved addresses), but your personal information will be handled in accordance with our Privacy Policy.

4. Permitted & Prohibited Uses of the Website

4.1 Permitted Uses

You may use the Website only for lawful, non-commercial, and personal purposes that align with these Terms, including:

  • Creating and managing a User Account to track orders and save preferences.
  • Placing orders for products in compliance with the Terms of Purchase.
  • Contacting customer support for assistance with Website use or orders.
  • Downloading or printing small amounts of Website content (e.g., a product page) for personal, non-commercial use—provided you retain all proprietary notices (e.g., copyright or trademark symbols).

4.2 Prohibited Uses

You may not use the Website for any of the following activities, and Dooneyd reserves the right to take legal action against you if you do:
  • Violating any applicable laws, regulations, or third-party rights (e.g., copyright infringement, trademark infringement, invasion of privacy).
  • Accessing or attempting to access restricted areas of the Website (e.g., administrative portals, database servers) without authorization.
  • Using automated tools (e.g., bots, scrapers, crawlers) to collect, copy, or extract Website content (e.g., product data, user information) without explicit written permission from Dooneyd.
  • Uploading, transmitting, or distributing harmful, offensive, or misleading content (e.g., malware, viruses, spam, false product reviews, hate speech, or content that violates privacy laws).
  • Interfering with the Website’s functionality (e.g., disrupting server operations, overloading the platform with excessive requests, or modifying Website code).
  • Impersonating another person or entity (e.g., creating an account under a false name, pretending to be a Dooneyd employee or representative).
  • Reselling, renting, licensing, or commercializing any Website content, features, or services (e.g., using product images to sell competing products, sharing account access for a fee).
  • Engaging in fraudulent activity (e.g., placing orders with stolen payment methods, claiming false product defects to obtain refunds).

5. Intellectual Property Rights

All content on the Website—including product images, descriptions, logos, trademarks (e.g., “Dooneyd”), text, graphics, videos, and software—is the exclusive property of Dooneyd or its licensors and is protected by international intellectual property laws (e.g., copyright, trademark, and patent laws).
You may not:
  • Reproduce, copy, modify, adapt, distribute, publish, display, or sell any Website content for commercial purposes.
  • Use Dooneyd’s trademarks, logos, or brand names (e.g., “Dooneyd”) in any way that could confuse consumers or imply endorsement by Dooneyd, without prior written permission.
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices on the Website or its content.
Dooneyd retains all intellectual property rights to the Website and its content. Nothing in these Terms grants you any ownership rights to such content.

6. Website Content Accuracy & Availability

Dooneyd strives to ensure that all Website content (e.g., product descriptions, prices, availability, images) is accurate and up-to-date. However, we do not warrant or guarantee:
  • The completeness, accuracy, or timeliness of Website content. For example, product colors may vary slightly due to device display settings, and temporary pricing errors may occur (we will correct such errors and notify you if they affect your order).
  • That the Website will be available 24/7 or free of interruptions, errors, or technical issues. Dooneyd may need to temporarily take the Website offline for maintenance, updates, or emergency repairs, and we will notify Users of planned downtime when possible.
Dooneyd reserves the right to update or correct Website content at any time, without prior notice. If you notice an error (e.g., an incorrect product price or description), please contact customer service to report it.

7. Third-Party Links & Services

The Website may contain links to third-party websites or services (e.g., payment processors like PayPal, social media platforms, or shipping carriers). These links are provided for your convenience only and do not constitute an endorsement by Dooneyd of the third party’s content, products, or services.
Dooneyd has no control over third-party websites or services and is not responsible for their content, policies, or practices (e.g., privacy policies, terms of use). You access third-party links at your own risk. We recommend reviewing the terms of use and privacy policies of any third-party site before using it.

8. Disclaimer of Warranties

THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOONEYD DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

This limitation does not apply to damages caused by Dooneyd’s gross negligence, fraud, intentional misconduct, or violation of applicable laws (e.g., failure to protect your personal information as required by data protection laws).

10. Indemnification

Dooneyd reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with Dooneyd in defending such matter.

Dooneyd may update these Terms from time to time to reflect changes in laws, technology, or business practices. When changes are made:
  • We will update the “Last Updated” date at the top of this document.
  • We will post the revised Terms on the Website.
  • For material changes (e.g., changes to liability limitations, account rules, or permitted uses), we will notify you via email (sent to your registered account email) or a pop-up notice on the Website at least 7 days before the changes take effect.
Your continued access to or use of the Website after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Website.

If negotiation fails, the dispute shall be submitted to binding arbitration in New York City, New York, in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted by a single arbitrator, and the decision of the arbitrator shall be final and binding on both parties.
You waive any right to participate in a class action lawsuit or class-wide arbitration related to the Website or these Terms. Individual arbitrations shall be conducted on a one-on-one basis, and no class arbitrations or consolidated arbitrations shall be permitted.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
